Property Law
Property law is mainly regulated in the 4th Book of the Turkish Civil Code No. 4721 and is a branch of law that regulates real and limited real rights on all kinds of movable or immovable property with tangible assets, the scope of property rights, acquisition and transfer of property.
The main subjects of property law, which aims to protect the interests of people who have rights on goods, are real rights, possession and land registry. To touch upon the basic issues, real rights are absolute rights that enable people to have direct control over things and therefore can be claimed against anyone. Possession is the possession of a movable or immovable item by a person, regardless of ownership rights. The land registry is the registry kept under the responsibility of the State, in order to show the status of immovable properties and the rights thereon, in accordance with the principles of registration and openness.
