Makbule Mert and her children, Ubeydullah, Zihni and Fatih Mert, filed a non-pecuniary damage lawsuit against Enka and Bechtel companies, the owners of the vehicle that hit Üzeyir Mert and caused his death, in the amount of 125 billion 238 million 370 thousand lira compensation with legal interest.
June 21 – Makbule Mert and her children Ubeydullah, Zihni and Fatih Mert won compensation of 125 billion 238 million 370 thousand liras, including legal interest, in the non-pecuniary damage lawsuit they filed against Enka and Bechtel companies, the owners of the vehicle that hit Üzeyir Mert and caused his death. Makbule Mert and her children initiated enforcement proceedings against the companies for the compensation they could not collect.
Erendiz Önal, the lawyer of the Mert family, came to Ankara Courthouse today and submitted the “pursuit request” petition to the Ankara 19th Court of Execution in order to collect the compensation, which reached 125 billion 238 million 370 liras with legal interest, as per the decision of the Ankara 12th Civil Court of First Instance, which ruled the compensation. He gave it to the Directorate.
The incident in the case occurred on July 19, 1997, and the pickup truck with plate number 34 EYR 10, driven by Talip Adıgüzel, belonging to Enka A.Ş., was traveling from Konya to Samsun, near Türkiye Gübre Sanayi A.Ş., as a result of the loss of steering control. He crossed the median and hit 32-year-old Üzeyir Mert, the official driver who was waiting at the stop.
Üzeyir Mert died at the scene.
Following the accident, Üzeyir Mert’s wife Makbule Mert and their children Ubeydullah, Zihni and Fatih Mert filed a lawsuit against Enka, the owner of the vehicle that caused the accident, and its partner Bechtel companies, for a total of 6 billion 300 million liras of material and moral compensation, with legal interest to accrue as of July 19, 1997. He filed a lawsuit.
DRIVER WAS FOUND AT FAULT
The Mert family, through their lawyer Erendiz Önal, filed a lawsuit on August 8, 1997, and filed 3 more lawsuits to increase the amount of compensation after the expert report reaching the court determined that Talip Adıgüzel, the driver of the Enka company, was 8/8 at fault.
Ankara 12th Civil Court of First Instance, where the cases were heard, decided on May 9, 2000, after combining the 3 cases with the main case, that the defendant Enka and Bechtel companies paid a total of 42 billion with legal interest to the plaintiffs Makbule Mert and her children Ubeydullah, Fatih and Zihni Mert. It was decided that he would pay .709 million 834 thousand 991 liras In the public case filed against the driver Talip Adıgüzel after the accident, before the Ankara 20th Criminal Court of First Instance, Adıgüzel was sentenced to 2 years in prison and a heavy fine of 860 thousand liras on the grounds that “he caused the death of a person as a result of negligence and carelessness”. Taking into account “the personality of the defendant and the characteristics of the crime”, the court commuted Adıgüzel’s prison sentence to a .heavy fine of 7 million 300 thousand liras Makbule Mert and her 3 children filed a separate lawsuit at the Ankara 19th Civil Court of First Instance to impose a precautionary measure on the assets and bank accounts of Enka and Bechtel
companies.
