Property Law

Property law is primarily regulated in the fourth book of the Turkish Civil Code numbered 4721 and is a branch of law that regulates all types of immovable or movable property with material existence, the real rights and limited real rights on them, the scope of property rights, the acquisition and transfer of property rights.

Property law, which aims to protect the interests of individuals who have rights on the property, covers real rights, possession, and land registry as its main subjects. To briefly touch on the main subjects, real rights are absolute rights that directly establish dominance over the property and can be claimed against everyone. Possession is holding movable or immovable property independently of the right of ownership. The land registry is a register held under the responsibility of the state to show the status of real estates and their rights in accordance with the principles of registration and disclosure.
